By my signature below, I acknowledge that the Montachusett Ski and Snowboard Club (hereafter “MS&SC”)

Is a non-profit club with unpaid members and Executive Committee members, which has been organized and maintained to offer each member, and guest members, opportunities to participate in various social and athletic activities at a nominal cost. I acknowledge that I am aware of the hazards inherent in the sport of skiing and snowboarding and all club related activites, as well as the risks of loss, damages, death or personal injury, known or unknown, anticipated or unanticipated, which may result from participating in other activities with, or on premises controlled in whole or in part by, the MS&SC. I acknowledge that I participate at my own risk in any and all social or athletic activities of the MS&SC, and that I am solely responsible to evaluate and apply my own good judgment and capabilities at all times with respect to these activities. I agree to abide by all club rules, policies, procedures and guidelines at all times during the course of my membership.

In consideration of my membership in the MS&SC, I hereby agree for myself, all of my family, heirs, administrators, executors or assigns, to RELEASE the MS&SC and each and every one of its members, officers, directors, Executive Committee, leaders, volunteers or other agents, from liability, loss, actions, damages, claims, demands, or any causes of action; and NOT TO SUE OR OTHERWISE MAKE ANY CLAIM whatsoever against the MS&SC or any of its members, officers, directors, Executive Committee, leaders, volunteers or other agents for events or conditions arising out of my or my family’s participation in any activities of, or my or my family’s presence at premises controlled in whole or in part by, the MS&SC.

I expressly intend this RELEASE OF LIABILITY and COVENANT NOT TO SUE to be effective whether or not any loss, damage, death or personal injury RESULTS FROM THE NEGLIGENCE OF THE MS&SC and/or any of its members, officers, directors, Executive Committee, leaders, volunteers or other agents. I understand that negligence means the failure to do or act as a reasonably careful person would under the same or similar circumstances, or to commit and act that a reasonably careful person would not commit under the same or similar circumstances, to protect himself, herself, or others from damages, injury or death.
